What is copyright?

THERE is no official register for copyright in the UK. It is an unregistered right (unlike patents, registered designs or trade marks). There is no official action to take, (no application to make, forms to fill in or fees to pay).    How ever in the UK copyright can be registered for enforcement.

Copyright comes into effect immediately, as soon as something that can be protected is created and "fixed" in some way, e.g. on paper, on film, via sound recording, as an electronic record on the internet, etc.  

Copyright ownership can be found by looking for copyright symbol © followed by the owners name, to warn others against copying, but it is not legally necessary in the UK.

The type of works that copyright protects are:-

  1. original literary works, e.g. novels, instruction manuals, computer programs, lyrics for songs, articles in newspapers, some types of databases, but not names or titles (see Trade Marks page);
  2. original dramatic works, including works of dance or mime;
  3. original musical works;
  4. original artistic works, e.g. paintings, engravings, photographs, sculptures, collages, works of architecture, technical drawings, diagrams, maps, logos;
  5. published editions of works, i.e. the typographical arrangement of a publication;
  6. sound recordings, which may be recordings on any medium, e.g. tape or compact disc, and may be recordings of other copyright works, e.g. musical or literary;
  7. films, including videos; and
  8. broadcasts and cable programmers.

What are Trade Marks?

A trade mark is any sign which can distinguish the goods and services of one trader from those of another. A sign includes, for example, words, logos, pictures, or a combination of these.

Basically, a trade mark is a badge of origin, used so that customers can recognise the product of a particular trader.

To be register your trade mark must be:-

  • distinctive for the goods or services which you are applying to register it for,
    and
  • not deceptive, or contrary to law or morality,
    and
  • not similar or identical to any earlier marks for the same or similar goods or services.

None registered trade marks in the UK are the same as copyright and carry the logo ™

Registered Trade Marks carry the symbol ® in the UK.

Copyright;

The copyright and negatives and digital images remain the property of PCBT Photography, unless otherwise agreed in writing by PCBT Photography. ALL, transparencies, prints and other photographic materials and rights there of, shall in any case remain the property of PCBT Photography, until payment is made in full for such.

In accordance with the 1988 Copyright and Design Act, where photographs or designs are reproduced, a credit will appear mentioning PCBT Photography. Failure to do so in the absence of any other agreement in writing, will result in additional charges being made.

Excepting contracts containing contrary arrangements, fees paid to PCBT Photography, will be for the sole specified use of the image/s, additional usage must be paid for separately at the appropriate rates prevailing at the time.

Failure to comply with the above will result in a breach of copyright.

Delivery;

Unless otherwise requested, delivery of goods will be by first class mail or overnight carrier, depending on size of the package. Additional charges may be levied for special deliveries.

Copying;

Any materials accepted for copying or reproduction in any way will be taken on the understanding that the customer has obtained the relevant forms of copyright from the owner.

Payments;

Payment of accounts shall be due no later than 30 days from the end of the month in witch the invoice was issued. Interest will be charged weekly in advance on overdue payments at a rate of 2% above the base rate of the Midland Bank starting the first day that payment becomes overdue.

For non-account holder’s payment will by due on delivery of goods unless alternative arrangements have been made in writing. 

Photographic Interpretations;

In the absence of specific written instructions or verbal instructions from an authorized person present at the photographic session, the judgment of the photographer on matters of composition, interpretation and other relevant circumstances relating to the taking of the photographs shall be deemed correct.

Unless otherwise specified in writing, colour photographs will be taken using colour processing. A reasonable colour representation of the subject both on originals and subsequent reprints will be produced, but cannot be guaranteed to match.

Web Page Construction;

Any materials accepted for WEB PAGE construction will be taken on the understanding that the customer has obtained the relevant forms of copyright from the owner.

Photographs supplied by PCBT Photography for the web page also fall under the terms of PCBT Photography’s copyright terms.

The page will be constructed by PCBT Photography and carry the text “constructed by PCBT Photography for”. 

PCBT Photography reserves the right to terminate the contract and demand payment in full if the page contains links to pornographic pages, are found to be misleading or break any UK laws. Written notice will be given and discretion used by Patrick Trollope before action is taken. 

Supplying digital material;

Digital photographs are still classed under the same terms of traditional photographs.

Even though every effort is made by PCBT Photography to stop the transmission of viruses, PCBT Photography can not be held responsible for damage caused should the matter ever arise. 

All digital materials including digital photographs will be under the data protection act.

Payment for digital photographs will be made before delivery, unless agreed otherwise in writing.

Charges;

Charges will be made in £ Sterling.

All quotations and charges are based on information supplied by client in written form. Additional work will be charged accordingly.

Prints are quoted for printing from a whole negative to a reasonable colour match. Additional requirements such as cropping, retouching, enhancing, if not stated in original specifications, will be subject to an additional charge.

Dishonoured cheque will incur a additional charge of £15.00 and the full costs of any additional charges.

After the release of the first reminder subsequent reminders will incur a charge of £6.00 administration fee and a further £2.00 per item.  This can be wavered only by Patrick Trollope.

Photographs, Graphics, Art Work, Text etc. sent out for approval and not returned within 30 days, will be deemed to be purchased and charges will be issued accordingly. 

The word “photographic” shall also mean transparency, negative or any other image produced by silver, electronic or similar image processes. 

PCBT Photography has the right to demand payment on full amount for the work carried out, and the contract terminated, if a client is found to be breaking copyright and/or putting PCBT Photography into disrepute. Further action may be taken.
